Pro Tips

  • Always get a non-refundable retainer to secure the booking date
  • Be very clear about usage rights—this is where most disputes arise
  • Keep backup copies of all delivered images for at least a year
  • Include travel fees for shoots beyond your local area
  • Specify your editing style to manage expectations
  • Get model releases BEFORE the shoot, not after

Key Features of This Contract

Tiered Usage Licensing

Define exactly how clients can use images—web only, print, commercial, editorial, or exclusive. Each tier carries a different fee, letting you monetize the same shoot multiple times and charge appropriately for high-value commercial use. Prevents clients from assuming unlimited usage rights when they've only paid for personal or limited commercial use.

Weather & Force Majeure Clause

Outdoor shoots are weather-dependent. This clause defines what happens when conditions force rescheduling—who bears the cost, rebooking timelines, and whether deposits transfer to the new date. Protects photographers from losing income due to circumstances beyond control while being fair to clients who've planned around shoot dates.

Non-Refundable Retainer Protection

Secures booking dates with a non-refundable retainer that compensates photographers for turning away other work. Retainer amount and refund policy vary by cancellation timing, protecting against last-minute cancellations that leave photographers with empty calendars and lost income.

Editing Scope Definition

Specifies exactly what editing is included (color correction, basic retouching) versus advanced retouching that costs extra. Sets expectations about editing style and prevents clients from requesting extensive post-processing work without additional fees. Protects photographer time from endless retouching requests.

RAW File Ownership Control

Explicitly excludes RAW files from deliverables unless specifically included at premium pricing. RAW files are your digital negatives and represent your creative process—this clause protects them while allowing clients to purchase them separately if needed. Prevents clients from assuming they get all files from the shoot.

Model & Property Release Requirements

Clarifies client responsibility for obtaining necessary releases for commercial use, with photographer providing standard forms. Protects photographers from liability when clients use images commercially without proper releases, while ensuring commercial shoots can proceed legally.

Frequently Asked Questions

Who owns the copyright to photos I take for a client?

Unless your contract explicitly transfers copyright, you own it. What you sell is typically a license to use the images, not ownership. This is standard practice and allows you to use images in your portfolio.

Should I give clients RAW files?

Generally, no. RAW files are your digital negatives and represent your working process. If clients insist on RAW files, charge significantly more—these are valuable assets.

What's a reasonable cancellation policy?

Common terms: retainer non-refundable, 50% refund with 2+ weeks notice, no refund within 1 week. Adjust based on your market and booking demand.

How long should I keep photos?

6-12 months is typical for client images. Clearly communicate your policy and encourage clients to back up their images immediately.
